1. Introduction

These Terms of Service ("Terms") govern your access to and use of posibela.com and any purchase you make from us (the "Service"). The Service is operated by BOMING ENTERPRISES LLC, a Wyoming limited liability company, doing business as POSIBELA ("POSIBELA", "we", "us" or "our"), 30 N Gould St Ste R, Sheridan, WY 82801, United States.

By using the Service or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy and Subscription Policy, which are incorporated by reference. If you do not agree, please do not use the Service.

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will change. Changes do not apply to orders placed before the update.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service and place orders.

3. Your account

You are responsible for keeping your account login details confidential and for activity under your account. Please notify us immediately at contact@posibela.com of any unauthorized use. We may suspend or close accounts that violate these Terms.

4. Products and health information

Our products are dietary supplements. The statements on this website have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. Information on the Service is for general information only and is not medical advice. Always consult your doctor before using any supplement, especially if you are pregnant, breastfeeding, taking medication or have a medical condition. Individual results may vary.

We make reasonable efforts to display our products and their descriptions accurately, but colors and packaging may vary slightly.

5. Prices, orders and payment

All prices are shown in the currency displayed at checkout and may change without notice; changes do not affect orders already placed. Your order is an offer to purchase. We may refuse or cancel any order, including in case of pricing or availability errors, suspected fraud, or resale activity. If we cancel an order after you have been charged, we will refund you in full.

You confirm that you are authorized to use the payment method you provide and that your billing and shipping information is accurate.

6. Subscriptions

If you purchase a subscription, you agree to the recurring charges described at checkout and in our Subscription Policy. Your subscription renews automatically until you cancel. You can cancel at any time from your account or by emailing contact@posibela.com, at least 24 hours before your next billing date.

7. Promotions

Discount codes and promotions are subject to their stated conditions, may expire or be withdrawn at any time, have no cash value and cannot be transferred.

8. Shipping, refunds and returns

Shipping is governed by our Shipping Policy. Refunds are governed by our Refund Policy, including our 30-Day Money-Back Guarantee on first orders. Risk of loss passes to you when your order is delivered to the carrier; however, lost, damaged or incorrect orders are handled as described in our Refund Policy.

9. Where we sell

We currently sell and ship to the United States, United Kingdom, Canada, Australia and New Zealand. If you order from elsewhere, we may cancel your order and refund you.

10. Intellectual property

All content on the Service, including the POSIBELA name and logo, text, images, graphics and designs, is owned by or licensed to POSIBELA and protected by intellectual property laws. You may use the Service for personal, non-commercial purposes only. You may not copy, reproduce or resell our content or products without our written permission.

11. Reviews and user content

If you submit reviews, photos or other content, you confirm it is truthful and your own, and you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with the Service and our marketing. We may remove content at our discretion.

12. Prohibited use

You agree not to use the Service for any unlawful purpose, to interfere with its security or operation, to use bots or scrapers, to impersonate any person, or to purchase products for unauthorized resale.

13. Text messages (SMS)

If you opt in to receive text messages from POSIBELA, you agree to receive recurring automated marketing and order-related messages at the number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help, or email contact@posibela.com. Carriers are not liable for delayed or undelivered messages.

14. Third-party links and services

The Service may link to or use third-party services (for example, payment, shipping and subscription providers). We are not responsible for third-party websites or services, which are governed by their own terms.

15. Disclaimer of warranties

To the fullest extent permitted by law, the Service and products are provided "as is" and "as available", without warranties of any kind, express or implied, except as expressly stated in our policies. We do not guarantee specific results from using our products.

16. Limitation of liability

To the fullest extent permitted by law, POSIBELA will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

17. Indemnification

You agree to indemnify and hold POSIBELA harmless from claims arising from your breach of these Terms or misuse of the Service, to the extent permitted by law.

18. Dispute resolution and governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Before filing any claim, please contact us at contact@posibela.com so we can try to resolve the issue informally.

If you are in the United States, any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may instead bring an individual claim in small claims court. You and we waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing contact@posibela.com within 30 days of your first purchase.

19. Your consumer rights

If you live outside the United States (for example, in the United Kingdom, Canada, Australia or New Zealand), nothing in these Terms limits any rights you have under the mandatory consumer protection laws of your country, and you may bring claims in the courts of your country of residence where the law allows.

20. Copyright complaints

If you believe content on the Service infringes your copyright, email contact@posibela.com with the subject "Copyright Notice", identifying the work, the infringing material and your contact details.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. These Terms and our policies are the entire agreement between you and POSIBELA regarding the Service.
